Bruen, striking down as unconstitutional New York&#8217;s &#8220;proper cause&#8220; requirement for issuance of a permit to carry a handgun. The Court confirmed what we&#8217;ve long believed to be true; that there exists a right to carry a handgun for self-defense beyond one&#8217;s home. New York&#8217;s &#8220;proper cause&#8220; requirement is indistinguishable from Maryland&#8217;s &#8220;good and substantial reason&#8220; requirement for issuance of a carry permit. The opinion leaves no doubt that Maryland&#8217;s &#8220;good and substantial reason&#8220; requirement is unconstitutional:&#8221;][vc_column_text]The constitutional right to bear arms in public for self-defense is not \u201ca second-class right, subject to an entirely different body of rules than the other Bill of Rights guarantees.\u201d McDonald, 561 U. S., at 780 (plurality opinion). We know of no other constitutional right that an individual may exercise only after demonstrating to government officers some special need. That is not how the First Amendment works when it comes to unpopular speech or the free exercise of religion. It is not how the Sixth Amendment works when it comes to a defendant\u2019s right to confront the witnesses against him. And it is not how the Second Amendment works when it comes to public carry for self-defense.<\/p>\n<p>New York\u2019s proper-cause requirement violates the Fourteenth Amendment in that it prevents law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms. We therefore reverse the judgment of the Court of Appeals and remand the case for further proceedings consistent with this opinion.<\/p>\n<p><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_new_m648.pdf\">\u2013New York State Rifle &amp; Pistol Association Inc. v. Bruen, 597 U.S. ___ (2022)<\/a>[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;&#8220;Good and substantial reason&#8220; is unconstitutional and is therefore unenforceable. Full stop.&#8221;][vc_column_text]On July 5th, 2022, Governor Larry Hogan<a href=\"https:\/\/governor.maryland.gov\/2022\/07\/05\/governor-hogan-directs-maryland-state-police-to-suspend-good-and-substantial-reason-standard-for-wear-and-carry-permits\/\"> issued the following statement<\/a>:<\/p>\n<p>Over the course of my administration, I have consistently supported the right of law-abiding citizens to own and carry firearms, while enacting responsible and common sense measures to keep guns out of the hands of criminals and the mentally ill. \u201cLast month, the U.S. Supreme Court struck down a provision in New York law pertaining to handgun permitting that is virtually indistinguishable from Maryland law. In light of the ruling and to ensure compliance with the Constitution, I am directing the Maryland State Police to immediately suspend utilization of the \u2018good and substantial reason\u2019 standard when reviewing applications for Wear and Carry Permits. It would be unconstitutional to continue enforcing this provision in state law. There is no impact on other permitting requirements and protocols. \u201cToday\u2019s action is in line with actions taken by other states in response to the recent ruling.\u201d[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;In response, the Maryland State Police provided this advisory:&#8221;][vc_column_text]The Maryland State Police Licensing Division is in the process of updating the Licensing Portal to reflect these changes. Until these updates are complete, applicants submitting a Wear and Carry Permit application are directed to select \u201cPersonal Protection \/ Category Not Listed Above\u201d as their \u201cHandgun Permit Category\u201d. Applicants are not required to attach documents to the \u201cPERSONAL PROTECTION DOCUMENTATION\u201d section on the \u201cUpload Documents\u201d page of the Wear and Carry Permit application.<\/p>\n<p>Additional information and a link to the Licensing Portal, can be found on the Maryland State Police website. <a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision.aspx\">Maryland State Police Licensing Division<\/a>.<\/p>\n<p>We welcome the Governor\u2019s order and the decision to comply with the Supreme Court\u2019s decision in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_new_m648.pdf\">Bruen<\/a>. For the first time in decades, ordinary responsible, law-abiding citizens in Maryland will have their Second Amendment right for self-defense outside the home respected. We stress that permit holders, nationwide, are the most law-abiding persons there are, with crime rates far below that of commissioned police officers. The Second Amendment is not a threat to the public. It protects the right of self-defense and that protection is fully consistent with public safety.<\/p>\n<p>Separately, the Maryland Court of Special Appeals found that the \u201cgood and substantial reason\u201d requirement is unconstitutional under the 2nd Amendment. Find its opinion <a href=\"https:\/\/www.marylandshallissue.org\/jmain\/documents\/summary\/4-public-documents\/373-in-the-matter-of-william-rounds-md-court-of-special-appeals-reported-opinion-precedential\">HERE<\/a>.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Maryland Carriage and Transport of Handguns&#8221;][vc_column_text]Maryland has\u00a0a blanket ban on the carriage and transport of\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N24D508706AB711E783EBFAD922F6D935?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">handguns<\/a>\u00a0within the state,\u00a0<em><a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/ND1E4D3A0833511E8A44AFB83F981CD6C?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">with exceptions<\/a><\/em>. One of those exceptions is for those who\u2019ve been issued a license, known as a\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Firearms\/WearandCarryPermit.aspx\" target=\"_blank\" rel=\"noopener\">Wear and Carry Permit<\/a>, which is\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N08AE98409CE711DB9BCF9DAC28345A2A?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">required<\/a>\u00a0to be able to lawfully carry a handgun concealed\u00a0<em><strong>or<\/strong><\/em>\u00a0openly in public for self-defense (concealed and open carry are both lawful with a permit). This permit is described in State law under\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Browse\/Home\/Maryland\/MarylandCodeCourtRules?guid=N5D2759909CC211DB9BCF9DAC28345A2A&amp;originationContext=documenttoc&amp;transitionType=Default&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">Maryland Public Safety Article \u00a7\u00a7 5-301 through 5-314<\/a>\u00a0and is issued by the\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Pages\/default.aspx\">Maryland State Police<\/a>\u00a0(MSP) through its\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision.aspx\">Licensing Division<\/a>\u00a0(MSPLD). The Licensing Division follows its own\u00a0<a href=\"https:\/\/www.marylandshallissue.org\/jmain\/documents?task=download.send&amp;id=354&amp;catid=4&amp;m=0\" target=\"_blank\" rel=\"noopener\">Standard Operating Procedures<\/a>\u00a0for how permits are issued and managed. Applicants for a permit must satisfy several requirements before being considered qualified. The process typically takes\u00a0<strong>between 60 to 90 days<\/strong>\u00a0for most applicants.<strong>\u00a0<\/strong><\/p>\n<p>While the \u201cgood and substantial reason\u201d requirement is now unenforceable, Maryland\u2019s other requirements for a carry permit are not directly affected by the decision in Bruen. Those other requirements include training, fingerprinting, and background checks. Bruen did NOT convert Maryland (or any other state) into a permitless state. Carry permits issued by Maryland are still required by law to carry a handgun in public. Maryland still does not currently recognize carry permits issued by any other state.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Who is Eligible for a Permit?&#8221;][vc_column_text]\n<div>The\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision.aspx\" target=\"_blank\" rel=\"noopener\">Maryland State Police Licensing Division<\/a>\u00a0(MSPLD) issues permits to applicants in accordance with\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N2F1EED20EFF811E287538FE6867B56CD?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">Md. Public Safety Art. \u00a7 5-306<\/a>.\u00a0Generally, this includes all responsible, law-abiding persons not prohibited by\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Documents\/State%20Prohibitors.pdf\" target=\"_blank\" rel=\"noopener\">state<\/a>\u00a0or\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Documents\/Federal%20Prohibitors.pdf\" target=\"_blank\" rel=\"noopener\">federal<\/a>\u00a0law from possessing firearms (with exceptions) and of at least 21 years of age and who complete the State\u2019s requirements.\u00a0The right to carry a handgun for self-defense is sufficient reason to apply for an unrestricted permit. Permit applicants must submit completed applications through the\u00a0<a href=\"https:\/\/licensingportal.mdsp.maryland.gov\/MSPBridgeClient\/#\/home\" target=\"_blank\" rel=\"noopener\">Maryland State Police Licensing Portal<\/a>. That Portal allows the applicant to include proof of training or exemption, fingerprints, passport-style photo, and $75 non-refundable fee. Use of the Portal does require one to have an email address. Maryland\u00a0<em>does issue<\/em>\u00a0permits to residents of other states, but they must be trained (or\u00a0<a href=\"https:\/\/www.marylandshallissue.org\/jmain\/information\/md-carry-permits#c\">training exempt<\/a>) by an\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Training\/QualifiedHandgunInstructor.aspx\" target=\"_blank\" rel=\"noopener\">MSP Qualified Handgun Instructor<\/a>\u00a0and must be\u00a0<a href=\"https:\/\/www.dpscs.state.md.us\/publicservs\/fingerprint.shtml\" target=\"_blank\" rel=\"noopener\">LiveScan fingerprinted<\/a>\u00a0by an entity in Maryland and meet the other requirements applicable to residents.<\/div>\n<p><a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N2F1EED20EFF811E287538FE6867B56CD?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">Md. Public Safety Art. \u00a7 5-306(a)<\/a><\/p>\n<p>(a) Subject to subsection (c) of this section, the Secretary shall issue a permit within a reasonable time to a person who the Secretary finds:<br \/>\n(1) is an adult;<br \/>\n(2)(i) has not been convicted of a felony or of a misdemeanor for which a sentence of imprisonment for more than 1 year has been imposed; or<br \/>\n(ii) if convicted of a crime described in item (i) of this item, has been pardoned or has been granted relief under 18 U.S.C. \u00a7 925(c);<br \/>\n(3) has not been convicted of a crime involving the possession, use, or distribution of a controlled dangerous substance;<br \/>\n(4) is not presently an alcoholic, addict, or habitual user of a controlled dangerous substance unless the habitual use of the controlled dangerous substance is under legitimate medical direction;<br \/>\n(5) except as provided in subsection (b) of this section, has successfully completed prior to application and each renewal, a firearms training course approved by the Secretary that includes:<br \/>\n(i) 1. for an initial application, a minimum of 16 hours of instruction by a qualified handgun instructor; or<br \/>\n2. for a renewal application, 8 hours of instruction by a qualified handgun instructor;<br \/>\n(ii) classroom instruction on:<br \/>\n1. State firearm law;<br \/>\n2. home firearm safety; and<br \/>\n3. handgun mechanisms and operation; and<br \/>\n(iii) a firearms qualification component that demonstrates the applicant\u2019s proficiency and use of the firearm; and<br \/>\n(6) based on an investigation:<br \/>\n(i) has not exhibited a propensity for violence or instability that may reasonably render the person\u2019s possession of a handgun a danger to the person or to another; and<br \/>\n(ii) has good and substantial reason to wear, carry, or transport a handgun, such as a finding that the permit is necessary as a reasonable precaution against apprehended danger.\u00a0[This requirement is invalid under\u00a0<em>Bruen<\/em>]\n<p><strong>Applicants under the age of 30 face extra scrutiny, as imposed by\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N2F1EED20EFF811E287538FE6867B56CD?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">\u00a7 5-306(c)<\/a><\/strong><\/p>\n<p>(c) An applicant under the age of 30 years is qualified only if the Secretary finds that the applicant has not been:<br \/>\n(1) committed to a detention, training, or correctional institution for juveniles for longer than 1 year after an adjudication of delinquency by a juvenile court; or<br \/>\n(2) adjudicated delinquent by a juvenile court for:<br \/>\n(i) an act that would be a crime of violence if committed by an adult;<br \/>\n(ii) an act that would be a felony in this State if committed by an adult; or<br \/>\n(iii) an act that would be a misdemeanor in this State that carries a statutory penalty of more than 2 years if committed by an adult.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Who Should Apply?&#8221;][vc_column_text]Wear and Carry Permits may be issued to any adult (18 years of age or over) who meets the following criteria:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li>An applicant between 18 and 21 years of age may only be issued a wear and carry permit to possess a regulated firearm required for employment. \u2013 P.S. 5-133 (d)(2)(v)<\/li>\n<li>Has not been convicted of a felony or a misdemeanor for which a sentence of imprisonment for more than one year has been imposed; or convicted of a criminal offense for which you could have been sentenced to more than 2 years incarceration.<\/li>\n<li>Has not been convicted of a crime involving the possession, use, or distribution of a controlled dangerous substance;<\/li>\n<li>Is not presently an alcoholic, addict, or habitual user of a controlled dangerous substance unless under legitimate medical direction;<\/li>\n<li>Based on an investigation, has not exhibited a propensity for violence or instability that may reasonably render the person\u2019s possession of a handgun a danger to the person or others;<\/li>\n<li>As of October 1, 2013, has successfully completed the Maryland State Police\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Training\/WearandCarryPermit.aspx\">approved firearms training course<\/a>\u00a0within 2 years\u00a0<strong>prior<\/strong>\u00a0to submitting the original or renewal application.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;How Much Does It Cost?&#8221;][vc_column_text]All fees will be collected electronically at the time of application submission in the Licensing Portal. Acceptable forms of payment include Visa and MasterCard.<\/p>\n<p>Original\/Initial \u2013 $75.00 \u2013 Fingerprint Fees not included<br \/>\nRenewal \u2013 $50.00 \u2013 Fingerprints No Longer Required<br \/>\nSubsequent \u2013 $50.00 \u2013 Fingerprint Fees not included<br \/>\nReplacement\/Modification \u2013 $10.00 \u2013 Fingerprints not required<\/p>\n<p>Active\/Retired Law Enforcement Officers of this State or a County\/Municipality (PS 5-304) \u2013 $0.00[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;When Should I Renew?&#8221;][vc_column_text]The initial Handgun Permit expires on the last day of the holder\u2019s birth month following two (2) years after the date the permit is issued. Permits that have been modified or are a duplicate expire on the date provided on the initial permit.<\/p>\n<p>A Handgun Permit may be renewed for successive periods of three (3) years each if, at the time of an application for renewal, the applicant possesses the qualifications for the issuance of a permit and pays the renewal fee as established in the subtitle.<\/p>\n<p>The renewal process is the responsibility of the applicant and should be started no less than 90 business days from expiration of the permit. Timely renewal is the responsibility of the permit holder. The Licensing Portal will only send out renewal reminders for Wear and Carry permit applications that have been submitted through the online portal.<\/p>\n<p>It is the permit holder\u2019s responsibility to notify the Licensing Division of address changes, in writing, within 30 days of any change. You must mail this change to the same address as you would mail an application.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Training&#8221;][vc_column_text]Maryland Wear and Carry Permit Training must be completed\u00a0<em>before<\/em>\u00a0submission of an application. Under\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N2F1EED20EFF811E287538FE6867B56CD?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">Md. Public Safety Art. \u00a7 5-306<\/a>\u00a0and\u00a0<a href=\"http:\/\/mdrules.elaws.us\/comar\/29.03.02.05\" target=\"_blank\" rel=\"noopener\">COMAR\u00a0<\/a><span id=\"CiteTitle\"><a href=\"http:\/\/mdrules.elaws.us\/comar\/29.03.02.05\" target=\"_blank\" rel=\"noopener\">Sec. 29.03.02.05<\/a>,<\/span>\u00a0these classes must consist of material on state (Maryland) firearm law, home firearm safety, handgun mechanisms and operation, and a firearms qualification component that demonstrates the applicant\u2019s proficiency and use of the firearm. Unless otherwise exempt from the training requirements, an applicant must get this training from an\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Training\/QualifiedHandgunInstructor.aspx\" target=\"_blank\" rel=\"noopener\">MSP Qualified Handgun Instructor<\/a> and complete a 16-hour training course for an initial application with a minimum 70% accuracy rating by the applicant in the live fire portion of the class. These classes often run anywhere from $250 to $400 and up. An 8-hour course will be required upon renewal of an issued permit. Public Safety Art. \u00a7 5-306(b)<\/a><\/p>\n<p>(b) An applicant for a permit is not required to complete a certified firearms training course under subsection (a) of this section if the applicant:<br \/>\n(1) is a law enforcement officer or a person who is retired in good standing from service with a law enforcement agency of the United States, the State, or any local law enforcement agency in the State;<br \/>\n(2) is a member, retired member, or honorably discharged member of the armed forces of the United States or the National Guard;<br \/>\n(3) is a qualified handgun instructor; or<br \/>\n(4) has completed a firearms training course approved by the Secretary.<\/p>\n<p>Note that law enforcement officers of another State are NOT exempt, only federal and Maryland law enforcement officers are exempt. Public Safety Art. \u00a7 5-101(q)<\/a>\u00a0as:<\/p>\n<div>(q) \u201cQualified handgun instructor\u201d means a certified firearms instructor who:<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_IE43AEED6BEBD11E2B401FE11986D2056\" class=\"co_paragraph\">\n<div class=\"co_paragraphText co_indentLeft1\">\u00a0(1) is recognized by the Maryland Police and Correctional Training commissions;<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_IE43AEED7BEBD11E2B401FE11986D2056\" class=\"co_paragraph\">\n<div class=\"co_paragraphText co_indentLeft1\">\u00a0(2) has a qualified handgun instructor license issued by the Secretary; or<\/div>\n<\/div>\n<\/div>\n<div class=\"co_contentBlock co_subsection\">\n<div id=\"co_anchor_IE43B15B0BEBD11E2B401FE11986D2056\" class=\"co_paragraph\">\n<div class=\"co_paragraphText co_indentLeft1\">\u00a0(3) has a certification issued by a nationally recognized firearms organization.<\/div>\n<div>\n<p>They are further described in Code of Maryland Regulations (COMAR)\u00a0<a href=\"http:\/\/mdrules.elaws.us\/comar\/29.03.01\" target=\"_blank\" rel=\"noopener\">Title 29, Subtitle 3, Chapter 29.03.01, \u00a7\u00a7 29.03.01.37 \u2013 29.03.01.41<\/a>.<\/p>\n<p>A current firearms instructor who\u2019d like to become an\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Training\/QualifiedHandgunInstructor.aspx\" target=\"_blank\" rel=\"noopener\">MSP Qualified Handgun Instructor<\/a>\u00a0and provide the Wear and Carry Course can submit their credentials through the MSP\u2019s website\u00a0<a href=\"https:\/\/emdsp.mdsp.org\/egov\/Login.aspx\">HERE<\/a>. Once a certificate is returned by the MSP, the instructor will be able to provide Maryland courses and will be listed publicly on\u00a0<a href=\"https:\/\/emdsp.mdsp.org\/verification\/\" target=\"_blank\" rel=\"noopener\">their website<\/a>. Basically, any NRA-certified instructor for the Basic Pistol class can qualify.<\/p>\n<\/div>\n<\/div>\n<\/div>\n[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Submitting the Application&#8221;][vc_column_text]Applications for Wear and Carry Permits can only be submitted online via the\u00a0<a href=\"https:\/\/licensingportal.mdsp.maryland.gov\/MSPBridgeClient\/#\/home\" target=\"_blank\" rel=\"noopener\">Maryland State Police Licensing Portal<\/a>. Applications can be started at any time but may be submitted only after all requirements are fulfilled and the application is\u00a0<em>complete<\/em>. Public Safety\u00a0\u00a7 5-306(a)<\/a>\u00a0states that the Maryland State Police shall issue a permit within a \u201creasonable timeframe\u201d and\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N3EEA50B1573811EA99CEE2EE8F0EE862?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">\u00a7 5-312(a)(2)<\/a>\u00a0provides:<\/p>\n<p>(2) A person whose application for a permit or renewal of a permit is not acted on by the Secretary within 90 days after submitting the application to the Secretary may request a hearing before the Office of Administrative Hearings by filing a written request with the Secretary and the Office of Administrative Hearings.<\/p>\n<p>Also,\u00a0<a href=\"https:\/\/www.marylandshallissue.org\/jmain\/documents?task=download.send&amp;id=354&amp;catid=4&amp;m=0\" target=\"_blank\" rel=\"noopener\">Processing of Handgun Permit Applications SOP 29-19-004<\/a>\u00a0at .05 Procedures, A. Responsibilities 3. states:<\/p>\n<p>The Handgun Permit Unit personnel will:<br \/>\na. ensure all permits are issued in accordance with: 18 U.S.C. \u00a7922(g) (1-9), Annotated Code of Maryland, Public Safety Article, Title 5, Sub-Title 3, Annotated Code of Maryland, Public Safety Article \u00a75-133 and the Code of Maryland Regulations, Title 29.03.02.<br \/>\nb. within three business days of receipt, applicable applications will be forwarded to the Administrative Investigation Unit, to conduct a background investigation, as required in the Annotated Code of Maryland, Public Safety Article, \u00a75-306.<br \/>\nc. ensure all applicants meet the requirements outlined in the Annotated Code of Maryland, Public Safety Article, \u00a75-306.<br \/>\nd. ensure approval or denial of all initial applications within 90 days of the receipt of an accepted application.<br \/>\ne. ensure approval or denial of all renewal applications within 45 days of the receipt of an accepted application.<br \/>\nf. track all applications, initial and renewal, to ensure issuance within 90 days or 45 days respectively.<br \/>\ng. act as the liaison between the Licensing Division, the Handgun Permit Review Board* and the Office of Administrative Hearings.<br \/>\nh. maintain all records, and track all decisions issued by the Handgun Permit Review Board* and the Office of the Administrative Hearings.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Handgun Qualification License Issuance&#8221;][vc_column_text]If you do not already have a\u00a0<a href=\"https:\/\/web.archive.org\/web\/20220828214848\/https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Firearms\/HandgunQualificationLicense.aspx\" target=\"_blank\" rel=\"noopener\">Maryland Handgun Qualification License<\/a>\u00a0(HQL), the license Maryland requires to be able to purchase handguns, you can request one from the MSP at no added cost and without further training\u00a0<em>after<\/em>\u00a0being issued a Wear and Carry Permit. The State Police have a separate portal for applying for the HQL here:\u00a0<a href=\"https:\/\/web.archive.org\/web\/20220828214848\/https:\/\/emdsp.mdsp.org\/egov\/Home.aspx\">https:\/\/emdsp.mdsp.org\/egov\/Home.aspx<\/a>.<br \/>\n<a href=\"https:\/\/web.archive.org\/web\/20220828214848\/https:\/\/emdsp.mdsp.org\/egov\/PersonSearchResults.aspx\" target=\"_blank\" rel=\"noopener\">Create an account<\/a>\u00a0and then when applying, make the following selections pictured below and click \u201cStart Application\u201d<\/p>\n<p>With respect to the Wear and Carry Permit, on 7\/22\/2022, the State Police\u00a0<a href=\"https:\/\/news.maryland.gov\/msp\/2022\/07\/22\/maryland-state-police-licensing-division-portal-update\/\" target=\"_blank\" rel=\"noopener\">issued an update<\/a>\u00a0on their efforts to meet the increased demand for permits and address many of the common problems encountered with incomplete applications.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Permit Restrictions&#8221;][vc_column_text]As of 7\/7\/2022, any restrictions printed on the reverse side of previously-issued permits are no longer in effect and are no longer being issued prospectively. See\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Licensing%20Division%20Documents\/LD-HPU-22-003%20W%26C%20Permit%20Modification%20Guidance.pdf\" target=\"_blank\" rel=\"noopener\">Maryland State Police Licensing Division Advisory LD-HPU-22-003 \u201cW&amp;C Permit Modifications\u201d<\/a>.<\/p>\n<p>MSI recommends applying for a $10 modification for a card explicitly without restrictions. Carry permit holders are still exceedingly rare in Maryland and law enforcement agencies do not regularly encounter them. Being wrongfully detained is still a risk.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Where are Firearms Prohibited?&#8221;][vc_column_text]\n<div>Restriction on the wear, carry and transport of handguns and firearms in certain places appear throughout Maryland law and regulations. \u00a0Below are statutes and regulations detailing the handgun and firearm restrictions. \u00a0This list should not be considered all-inclusive.<\/div>\n<p>1. On school property\u00a0<a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gcr&amp;section=4-102&amp;ext=html&amp;session=2020RS\" target=\"_blank\" rel=\"noopener\">(CR 4-102)<\/a><\/p>\n<p>2. Within 1,000 feet of a demonstration in a public place\u00a0<a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gcr&amp;section=4-208&amp;ext=html&amp;session=2020RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">(CR 4-208)<\/a><\/p>\n<p>3. In legislative buildings\u00a0<a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gsg&amp;section=2-1702&amp;ext=html&amp;session=2020RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">(SG 2-1702)<\/a><\/p>\n<p>4.\u00a0Aboard\u00a0aircraft\u00a0<a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gtr&amp;section=5-1008&amp;ext=html&amp;session=2020RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">(TR 5-1008)<\/a><\/p>\n<p>5. In lodging establishments where the innkeeper reasonably believes individuals possess property that may be dangerous to other individuals, such as firearms or explosives\u00a0<a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gbr&amp;section=15-203&amp;ext=html&amp;session=2020RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">(BR 15-203)<\/a><\/p>\n<p>6. On dredge boats,\u00a0other\u00a0than\u00a0two\u00a010\u00a0gauge\u00a0shotguns\u00a0<a href=\"http:\/\/mgaleg.maryland.gov\/webmga\/frmStatutesText.aspx?article=gnr&amp;section=4-1013&amp;ext=html&amp;session=2020RS&amp;tab=subject5\" target=\"_blank\" rel=\"noopener\">(NR 4-1013)<\/a><\/p>\n<p>7. In State Parks\u00a0<a href=\"http:\/\/mdrules.elaws.us\/comar\/08.07.06.04\" target=\"_blank\" rel=\"noopener\">(COMAR 08.07.06.04)<\/a><\/p>\n<p>11. In State Highway Rest Areas,\u00a0unless\u00a0properly\u00a0secured\u00a0within\u00a0vehicle\u00a0<a href=\"http:\/\/mdrules.elaws.us\/comar\/11.04.07.12\" target=\"_blank\" rel=\"noopener\">(COMAR 11.04.07.12)<\/a><\/p>\n<p>12. In community adult rehabilitation centers\u00a0<a href=\"http:\/\/mdrules.elaws.us\/comar\/12.02.03.10\" target=\"_blank\" rel=\"noopener\">(COMAR 12.02.03.10)<\/a><\/p>\n<p>13. In child care centers, except for small centers located in residences, firearms may not be kept on the premises\u200b\u00a0\u200b<a href=\"http:\/\/mdrules.elaws.us\/comar\/13a.16.10.04\" target=\"_blank\" rel=\"noopener\">(COMAR 13A.16.10.04)\u200b<\/a>[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Appeals Process&#8221;][vc_column_text]or those denied outright by the MSP, or if a permit contains unacceptable restrictions, options are available to seek the issuance or modification of a permit. Within 10 days of denial, one must appeal in writing to either the MSP to ask for an \u201cInformal Review\u201d or to the\u00a0<a href=\"https:\/\/www.oah.maryland.gov\/\" target=\"_blank\" rel=\"noopener\">Maryland Office of Administrative Hearings<\/a> (OAH). Appeals may also be taken to the OAH within 10 days of any decision of the MSP after an Informal Review.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Maryland State Police Informal Review&#8221;][vc_column_text]The MSP will allow applicants to present any further information regarding their denial to more senior management within the Licensing Division. Unless provided significant new information at that time, it is unlikely MSP\u2019s initial decision will be affected.<\/p>\n[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;h3&#8243; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Maryland OAH Formal Appeal&#8221;][vc_column_text]OAH hearings are run by Administrative Law Judges (ALJs) and are quasi-formal trials with rules and procedures. These proceedings are \u201cde novo\u201d which means that additional evidence can be submitted at these hearings. In an OAH proceeding, the focus is on whether the MSP\u2019s decision should be sustained and the applicant bears the burdens of proof and persuasion. The ALJ gives deference to the MSP\u2019s determination. An attorney is not legally required but is necessary as a practical matter. Decisions of the ALJ can be appealed to circuit court.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;default&#8221; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Places and Times In Which Firearms Can Not Be Legally Carried by a Permit Holder&#8221;][vc_column_text]\n<ul>\n<li>On public school property \u2013\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N13E6F2F0EBC711E58D63FD4AF33933AB?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">MD Code, Criminal Law, \u00a7 4-102<\/a><a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Laws\/StatuteText?article=gcr&amp;section=4-102&amp;enactments=false\" target=\"_blank\" rel=\"noopener\"><br \/>\n<\/a><\/li>\n<li>With the deliberate purpose of injuring or killing another person \u2013\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/ND1E4D3A0833511E8A44AFB83F981CD6C?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">Md. Code, Criminal Law, \u00a7 4-203(a)(1)(iv)<\/a><\/li>\n<li>While in the commission of a crime of violence \u2013\u00a0<a Permit holders should be aware of\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/N802BB3009CDB11DB9BCF9DAC28345A2A?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">MD Code, Criminal Law, \u00a7 4-206<\/a>, which guides how law enforcement officers may determine whether an individual is armed legally.[\/vc_column_text][\/toggle][toggle color=&#8221;Default&#8221; heading_tag=&#8221;default&#8221; heading_tag_functionality=&#8221;default&#8221; title=&#8221;Maryland State and Local Weapons Laws&#8221;][vc_column_text]Unlawfully carrying a handgun in violation of\u00a0<a href=\"https:\/\/govt.westlaw.com\/mdc\/Document\/ND1E4D3A0833511E8A44AFB83F981CD6C?viewType=FullText&amp;originationContext=documenttoc&amp;transitionType=CategoryPageItem&amp;contextData=(sc.Default)\" target=\"_blank\" rel=\"noopener\">MD Code, Criminal Law, \u00a7 4-203(a)(1)(i)<\/a>\u00a0is also a strict liability crime, which means there is no requirement that the individual knowingly or willfully carried in violation of the law. Of course, if your life is truly imminently at risk or you are at imminent risk of great bodily harm, and you can meet the\u00a0<em>other<\/em>\u00a0elements of lawful self-defense (including the duty to retreat if outside the home, if a safe avenue of retreat is available), as defined in the MD case law, your attorney could assert a complete defense to the First Degree Assault charge.<\/p>\n<p><strong>The Rule:<\/strong>\u00a0Don\u2019t pull it, and don\u2019t threaten with it, unless you would be otherwise justified in actually firing it. For First Degree Assault, the prosecutor need only show that the defendant used a firearm with an intent to frighten, that the defendant had the present ability to bring about physical harm and that the victim was aware of the threat. See\u00a0<a href=\"https:\/\/www.marylandshallissue.org\/jmain\/documents\/summary\/4-public-documents\/402-snyder-v-state-210-md-app-370-2013\" target=\"_blank\" rel=\"noopener\"><em>Synder v. State<\/em>, 210 Md.App.370, 382 (2013)<\/a>. Residents of other states\u00a0<strong>can apply<\/strong>\u00a0for a Maryland, and those applications are now being treated no differently than Maryland residents. But, again, applicants\u00a0<em>must<\/em>\u00a0be trained (or\u00a0<a href=\"https:\/\/www.marylandshallissue.org\/jmain\/information\/md-carry-permits#c\">training exempt<\/a>) by a\u00a0<a href=\"https:\/\/mdsp.maryland.gov\/Organization\/Pages\/CriminalInvestigationBureau\/LicensingDivision\/Training\/QualifiedHandgunInstructor.aspx\" target=\"_blank\" rel=\"noopener\">MSP Qualified Handgun Instructor<\/a>\u00a0and\u00a0<em>must<\/em>\u00a0be\u00a0<a href=\"https:\/\/www.dpscs.state.md.us\/publicservs\/fingerprint.shtml\" target=\"_blank\" rel=\"noopener\">LiveScan fingerprinted<\/a>\u00a0by an entity\u00a0<em>in<\/em>\u00a0Maryland.
